The Senate met at 11 a.m.
(Senator Tomblin, Mr. President, in the Chair.)
Prayer was offered by the Honorable Joseph M. Minard, a
senator from the twelfth district.
Pending the reading of the Journal of Wednesday, April 13,
2005,
On motion of Senator Kessler, the Journal was approved and the
further reading thereof dispensed with.
The Senate proceeded to the fourth order of business.
Senator White, from the Joint Committee on Enrolled Bills,
submitted the following report, which was received:
Your Joint Committee on Enrolled Bills has examined, found
truly enrolled, and on the 14th day of April, 2005, presented to
His Excellency, the Governor, for his action, the following bills,
signed by the President of the Senate and the Speaker of the House
of Delegates:
(S. B. No. 616), Relating to priority of legislative business for members and certain employees of Legislature.
(H. B. No. 2782), Increasing the number of members a
municipality may appoint to a board of park and recreation
commission from not less than three to not more than seven.
And,
(Com. Sub. for H. B. No. 3178), Relating to domestic violence
and clarifying when permanent injunctions and other provisions may
be granted in final divorce orders.

The Senate proceeded to the twelfth order of business.
Remarks were made by Senators Facemyer, Bowman, Kessler, Deem,
Sprouse, Minear and Weeks.
Thereafter, at the request of Senator Bowman, and by unanimous
consent, the remarks by Senator Facemyer were ordered printed in
the Appendix to the Journal.
At the request of Senator Kessler, unanimous consent being
granted, the remarks by Senator Bowman were ordered printed in the
Appendix to the Journal.
At the request of Senator Edgell, and by unanimous consent,
the remarks by Senator Kessler were ordered printed in the Appendix to the Journal.
At the request of Senator Sprouse, unanimous consent being
granted, the remarks by Senator Deem were ordered printed in the
Appendix to the Journal.
At the request of Senator Weeks, and by unanimous consent, the
remarks by Senators Sprouse and Minear were ordered printed in the
Appendix to the Journal.
Pending announcement of a majority party caucus,
Senator Chafin then moved that the Senate adjourn until
tomorrow, Friday, April 15, 2005, at 6 p.m.
The question being on the adoption of Senator Chafin's motion,
and on this question, Senator Chafin demanded the yeas and nays.
The roll being taken, the yeas were: Bailey, Boley, Bowman,
Caruth, Chafin, Deem, Edgell, Facemyer, Fanning, Foster, Harrison,
Helmick, Jenkins, Kessler, Love, McCabe, Minard, Minear, Plymale,
Prezioso, Sharpe, Weeks, White and Tomblin (Mr. President)--24.
The nays were: Hunter, McKenzie, Oliverio, Sprouse, Unger and
Yoder--6.
Absent: Barnes, Dempsey, Guills and Lanham--4.
So, a majority of those present and voting having voted in the
affirmative, the President declared Senator Chafin's motion had
prevailed.
In accordance with the foregoing motion, the Senate adjourned
until tomorrow, Friday, April 15, 2005, at 6 p.m.
